US Judge Orders Release of Abrego Garcia from ICE Detention

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without legal authority.

"Since his release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.

The case originates in a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his return to the United States to face human smuggling allegations, he was detained in federal detention.

In her order, the court pointed out that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The court proceedings involve disputed assertions. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing criminal case in Tennessee.

The court, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
